Agreement

This page is intended for the Steam store page, Steamworks, and in-game access.

1. Introduction

This End User License Agreement and Privacy Policy ("Agreement") governs your access to and use of Unscriptum (the "Game"), published by Habenula Games ("we", "us", or "our").

By installing, accessing, launching, or using the Game, you agree to this Agreement. If you do not agree, do not install, access, launch, or use the Game.

This Agreement is intended to be made available on the Game's Steam store page, within Steamworks, and/or inside the Game.

2. Age Requirement

The Game is intended for users aged 16 years or older. By using the Game, you confirm that you are at least 16 years old, or that you have the permission of your parent or legal guardian where required by applicable law.

We do not knowingly collect personal data from children under 16. If you believe that a child under 16 has provided us with personal data, contact us at [email protected].

3. License To Use The Game

Subject to your compliance with this Agreement and the Steam Subscriber Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for personal, non-commercial entertainment purposes through Steam.

You do not own the Game or any intellectual property rights in the Game. All rights not expressly granted to you are reserved by us and our licensors.

4. Restrictions

You must not:

  • copy, distribute, sell, rent, sublicense, or commercially exploit the Game except as expressly permitted by us;
  • reverse engineer, decompile, disassemble, or modify the Game except where permitted by applicable law;
  • use cheats, bots, automation, exploits, or unauthorized third-party tools;
  • interfere with Steam services, Unity Services, or any online functionality connected to the Game;
  • use the Game in a way that violates applicable law or the rights of others;
  • remove copyright, trademark, or other proprietary notices from the Game.

5. Steam Services

The Game is distributed through Steam and may use Steamworks features such as authentication, achievements, statistics, leaderboards, cloud saves, overlay features, DLC checks, and other platform functionality.

Your use of Steam is governed by the Steam Subscriber Agreement and Valve's applicable policies. Valve's agreements and privacy notices do not replace this Agreement or our Privacy Policy for data that we collect or process independently or through third-party analytics providers.

6. Ownership And Intellectual Property

The Game, including its code, gameplay systems, art, audio, text, user interface, characters, designs, logos, and other content, is protected by intellectual property laws. All rights are owned by us or our licensors.

7. Updates And Changes To The Game

We may provide updates, patches, fixes, balancing changes, content changes, or feature changes. Some updates may be required to continue using the Game. We do not guarantee that any particular feature, balance state, or online functionality will remain available indefinitely.

8. Disclaimer Of Warranties

To the maximum extent permitted by applicable law, the Game is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Game will be uninterrupted, error-free, secure, compatible with all hardware or software, or free from defects.

9. Limitation Of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of profits, loss of goodwill, or interruption of business.

Nothing in this Agreement limits liability where such limitation is prohibited by applicable law.

10. Termination

This Agreement remains effective until terminated. We may terminate or suspend your license if you materially breach this Agreement. Upon termination, you must stop using the Game and uninstall it if required.

11. Privacy Policy

This section explains how we collect, use, disclose, and retain information when you use the Game.

12. Information We Collect

When you use the Game, we may collect the following information:

(a) Gameplay events

Examples may include level starts, level completions, deaths, difficulty selections, in-game progression, feature usage, tutorial progression, and other gameplay-related events.

(b) Session data

Examples may include session start, session end, session duration, timestamps, country or region inferred by analytics services, game version, build version, language, and platform.

(c) Device information

Examples may include device model, operating system, hardware characteristics, screen information, app version, Unity/runtime information, and identifiers used by Unity Services, Unity Analytics, or the operating system.

(d) Crash and performance information

Examples may include crash reports, error logs, performance metrics, frame-rate related indicators, loading times, memory-related information, and diagnostic data.

(e) Hashed SteamID

If Steam is available, we may process a hashed version of your SteamID. We do not intend to send your raw SteamID to Unity Services or Unity Analytics unless this is technically necessary. The hashed SteamID is used to help us understand gameplay, retention, crashes, and performance without directly storing your raw Steam identifier in analytics.

(f) Unity identifiers

Unity Services and Unity Analytics may generate and use identifiers such as Unity player, device, installation, or app identifiers.

13. Purposes Of Processing

We use the information described above for:

  • balancing gameplay;
  • identifying and fixing bugs;
  • measuring retention and session behavior;
  • improving the Game;
  • diagnosing crashes and performance issues;
  • understanding how players use features and content;
  • maintaining and improving technical stability.

We do not use this analytics data to make legal or similarly significant automated decisions about you.

14. Analytics Providers

We use Unity Services and Unity Analytics to collect, process, and analyze analytics, crash, session, device, and performance data.

Unity may process this data as a service provider or processor according to its applicable terms and policies. Unity Services and Unity Analytics may process data on servers located in different countries.

15. Legal Basis For Processing

For users in the European Union, European Economic Area, United Kingdom, Switzerland, Brazil, Canada, Australia, California, and other jurisdictions where consent is legally required for analytics processing, we rely on your consent.

For users in jurisdictions where legitimate interest is an appropriate legal basis and consent is not specifically required, we rely on our legitimate interest in improving the Game, fixing bugs, balancing gameplay, maintaining stability, and understanding aggregated player behavior.

Where required by law, you may withdraw your consent at any time through the in-game analytics settings.

16. How To Opt Out

You can opt out of analytics collection through the in-game settings.

When analytics is disabled, we will stop sending new analytics events from the Game, except where limited technical data is strictly necessary to provide the Game, comply with law, protect security, or process your opt-out preference.

17. Data Retention

We retain analytics data for no longer than two years, unless a shorter period is required by applicable law or unless longer retention is necessary to comply with legal obligations, resolve disputes, prevent abuse, or enforce agreements.

We may retain aggregated or anonymized information that can no longer reasonably identify you.

18. Data Sharing

We may share data with:

  • Unity Services and Unity Analytics for analytics, crash, performance, and diagnostic processing;
  • service providers who help us operate, improve, or support the Game;
  • authorities or other parties where required by law;
  • parties involved in a business transfer, merger, acquisition, restructuring, or sale of assets.

We do not sell personal data in the ordinary meaning of selling personal information for money.

19. International Data Transfers

Because we use third-party service providers such as Unity Services and Unity Analytics, your information may be processed in countries other than your country of residence. Where required, we rely on appropriate safeguards for international transfers.

20. Your Privacy Rights

Depending on your location, you may have rights to:

  • request access to personal data;
  • request correction or deletion;
  • object to or restrict processing;
  • withdraw consent;
  • request data portability;
  • lodge a complaint with a data protection authority.

21. California And Similar Privacy Rights

22. Security

We use reasonable technical and organizational measures to protect information. However, no system is completely secure, and we cannot guarantee absolute security.

23. Third-Party Links And Services

The Game may interact with Steam, Unity Services, Unity Analytics, and other third-party services. These third parties may process information according to their own terms and privacy policies.

24. Changes To This Agreement

We may update this Agreement from time to time. If we make material changes, we may provide notice through Steam, in-game notice, or another reasonable method. Continued use of the Game after changes become effective means you accept the updated Agreement.
